1. Introduction

Elephant Enterprises LLC ("Elephant Enterprises," "we," "us," or "our") owns and operates Tino — an application and online platform that helps users manage their screen time and build healthier daily habits (collectively, the "Platform"). This Privacy Policy describes how we collect, use, share, and protect your information when you use the Platform.

This Privacy Policy applies to all applications and websites under the Elephant Enterprises LLC brand, including Tino. Capitalized terms used but not defined here have the meanings given in our Terms of Service.

If we make material changes to this Privacy Policy, we will post a revised version and update the "Last Updated" date, or contact you directly. If you have questions, please contact us at help@tinocat.com.

2. Information We Collect

Information you provide directly: We may collect information you provide when registering or using the Platform, including your name, email address, profile information, your responses to in-app questions (such as your goals and habits around screen time), and any content you enter or generate through the Platform (such as journal entries, reflections, and check-ins).

Photos you choose to take: Certain features of the Platform let you take photos with your device's camera — for example, to confirm that you have completed a healthy activity or to take part in camera-based exercises. Photo-based verification is optional: photos are captured only when you actively choose to take them, and you can use the Platform without these features. Photos are analyzed solely for the purpose of evaluating whether an activity was completed and providing feedback, and we may use third-party artificial-intelligence providers to perform this analysis on our behalf. We do not use your photos for advertising, and we do not sell them.

We do not record sound. The Platform does not record audio and does not use your device's microphone to capture sound.

Screen-time and app-limit settings: The Platform uses Apple's Screen Time and Family Controls frameworks to help you limit the apps you choose. Your selection of apps to limit is handled by Apple's frameworks on your device; Apple provides this selection to the app in an opaque form, and we do not receive a human-readable list of the specific apps you block. Related settings (such as your daily limits and unlock history within Tino) are used to operate the service.

Information collected automatically: When you use the Platform, we automatically collect certain technical and usage information, including: device type and unique device identifiers, operating system and version, IP address, app usage patterns and preferences, session duration and feature usage, language and timezone settings, and general location information derived from your IP address.

Information from third parties: We may receive information about you from third-party services you connect to the Platform, or from analytics providers.

The Platform is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use the Platform or provide any personal information to us.

If we learn that we have collected personal information from a child under 13, we will take steps to delete that information as soon as possible. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at help@tinocat.com.

Users aged 13 to 17 may use the Platform with the consent and supervision of a parent or legal guardian. The parent or guardian is responsible for managing the minor's information and account. Parents may review, request deletion of, or refuse further collection of their child's personal information by contacting us at help@tinocat.com.

6. Data Retention and Deletion

We retain your personal information for as long as your account is active or as needed to provide services, comply with legal obligations, resolve disputes, and enforce our agreements. Photos used for activity verification are retained only as long as needed to provide the feature and related history.

Upon receiving your request to delete your account, we will deactivate your account and delete or anonymize your personal information within thirty (30) days, except where retention is required by law or necessary for legitimate business purposes (such as resolving disputes or maintaining security logs). Backup copies may take up to an additional ninety (90) days to be fully purged.

7. Data Breach Notification

In the event of a data breach that affects your personal information, we will notify affected users and relevant authorities in accordance with applicable law. Where required, we will provide notification within seventy-two (72) hours of becoming aware of the breach.

California Residents (CCPA/CPRA). If you are a California resident, you have the right to: know what personal information we collect, use, and disclose; request deletion of your personal information; opt out of the "sale" or "sharing" of personal information (we do not sell personal information); and not be discriminated against for exercising your privacy rights. Elephant Enterprises LLC complies with the California Business and Professions Code Sections 22575–22579.

Other US State Privacy Laws. Residents of states with comprehensive privacy laws (such as Virginia, Colorado, Connecticut, and others) may have similar rights. Please contact us at help@tinocat.com to exercise your rights under applicable state law.

9. Your Rights — International Users (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, additional rights and protections apply under the General Data Protection Regulation (GDPR) or equivalent legislation.

Lawful basis for processing. We process your personal data based on: your consent (which you may withdraw at any time); the necessity of performing our contract with you (i.e., providing the Platform); our legitimate interests (such as improving the Platform and preventing fraud); and compliance with legal obligations.

Your rights. You have the right to: access the personal data we hold about you; rectify inaccurate personal data; request erasure of your personal data ("right to be forgotten"); restrict or object to processing of your personal data; data portability (receive your data in a structured, machine-readable format); and withdraw consent at any time where processing is based on consent.

International transfers. Your information may be transferred to and processed in countries other than the country in which you reside. Where required, we rely on Standard Contractual Clauses or other approved transfer mechanisms to ensure adequate protection of your data when it is transferred outside the EEA.

10. Security

We implement physical, technical, and administrative safeguards designed to protect your information. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security. We encourage you to use strong passwords and keep your account credentials confidential.

11. Cookies and Tracking Technologies

We may use cookies, web beacons, and similar tracking technologies to identify you and remember your preferences when you use our web-based services. You can manage cookie preferences through your browser settings.

Global Privacy Control (GPC). We honor GPC signals sent by your browser as a valid opt-out of tracking where required by applicable law.

If you provide us with your contact information, we may send you service-related communications (such as account notifications, reminders you enable in the app, and security alerts). We may also send promotional communications, from which you may unsubscribe at any time by following the instructions in the message or by contacting us at help@tinocat.com.

The Platform may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services you access through the Platform.

14. Law Enforcement Requests

We may disclose your information to law enforcement or other authorities if compelled by a valid court order or if we reasonably believe disclosure is necessary to: comply with applicable law; protect the safety of any person; or prevent fraud or abuse of the Platform. Where permitted by law, we will attempt to notify you of such requests.

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date. For material changes, we will provide notice through the Platform or by other means. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Privacy Policy.

16. Accessing, Editing, and Deleting Your Information

You may access and edit your information through your account settings. To request deletion of your account or personal data, contact us at help@tinocat.com. We will process your request in accordance with applicable law and the data retention commitments described in Section 6.
